Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the Henry Import-Eksport website and client/admin portal (the "Platform") and the shipping and logistics services we provide between Albania, the United States, and Canada. By creating an account, placing an order, or otherwise using the Platform, you agree to these Terms.

1. Acceptance of Terms

By registering an account or using our services, you confirm that you are at least 18 years old and have the authority to agree to these Terms on your own behalf or on behalf of the party you represent.

2. Description of Service

Henry Import-Eksport arranges pickup, transport, customs coordination, and delivery of packages, vehicles, motorcycles, watercraft, and general cargo between Albania, the USA, and Canada. Estimated pickup, transit, and delivery dates shown on the Platform are estimates only and are not guaranteed delivery times.

3. Account Registration & Security

• You must provide accurate, current, and complete information when registering and keep it up to date.
• You are responsible for maintaining the confidentiality of your password and, where enabled, your two-factor authentication (2FA) method.
• You are responsible for all activity that occurs under your account and must notify us immediately of any unauthorized use.
• Staff and administrator accounts are managed internally and are activated or deactivated by an administrator; they are not deleted, to preserve the audit history of actions taken on the Platform.

4. Placing an Order

• You must provide accurate shipment details, including item description, declared value, weight, and origin/destination addresses.
• You are responsible for ensuring that your shipment does not contain prohibited, illegal, hazardous, or restricted items under the laws of the origin country, destination country, or any transit country.
• You are responsible for providing accurate documentation required for customs clearance (e.g. identification, vehicle titles, invoices) and for any customs duties, taxes, or fees assessed by customs authorities.
• We reserve the right to refuse, delay, or cancel any shipment that we reasonably believe violates these Terms or applicable law.

5. Pricing & Payment

• Prices are based on shipment type, weight, route, and any customs or handling fees, and are provided at the time of order or invoicing.
• Invoices are payable by the due date shown; accepted payment methods include bank transfer, card, cash, and PayPal, as made available on the Platform.
• Late payments may incur additional interest charges as stated on the invoice.
• Goods remain the property of Henry Import-Eksport until the associated invoice is paid in full.

6. Cancellations & Refunds

Orders may be cancelled before pickup for a full refund of any prepaid amount, minus any costs already incurred (e.g. customs filings). Once a shipment has been picked up or has entered transit, cancellation may not be possible and refunds are considered on a case-by-case basis.

7. Liability & Insurance

We take reasonable care in handling every shipment, but our liability for loss or damage is limited to the declared value of the shipment as stated at the time of order, unless additional insurance was purchased. We are not liable for delays caused by customs authorities, weather, carrier disruptions, or other circumstances outside our reasonable control.

8. Prohibited Uses

You agree not to use the Platform to:

• Ship items that are illegal, counterfeit, hazardous, or restricted by applicable law.
• Provide false or misleading information about a shipment, its value, or its contents.
• Attempt to gain unauthorized access to another user's account or to any part of the Platform reserved for staff or administrators.
• Interfere with or disrupt the security or normal operation of the Platform.

9. Intellectual Property

The Henry Import-Eksport name, logo, and the content and design of this Platform are the property of Henry Import-Eksport and may not be copied, reproduced, or used without our prior written consent.

10. Termination

We may suspend or terminate your access to the Platform if you violate these Terms. You may close your client account at any time by contacting us; records related to completed orders and invoices will be retained as described in our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the Republic of Albania, without regard to conflict of law principles, without prejudice to any mandatory consumer protection laws that may apply in your country of residence.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you through the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
